Article 1 Definitions

Terms and Conditions: These general terms and conditions apply to the use and access of the website www.waterjobs.nl

www.waterjobs.nl: www.waterjobs.nl is located at a registered office in Middelburg at the Noordpoortstraat 15. It is registered at the Chamber of Commerce in Middelburg under number 70244863 and hereinafter referred to as waterjobs.nl

User: the natural or legal person who makes use of the services offered by waterjobs.nl for placing CVs or vacancies.

Article 2 Purpose and costs

1. The website consists of a CV and vacancy database.

2. The placement of CVs is free.

3. There are costs associated with the posting of vacancies.

4. There are costs associated with placing online advertisements in the form of a Leaderboard or a banner.


Article 3 Third party websites

If waterjobs.nl links to websites of third parties, waterjobs.nl is not responsible for the content of these websites.


Article 4 Use

4.1 The use of the website by the user as well as the e-mail traffic between users takes place at their own expense and risk.

4.2 waterjobs.nl is not responsible for viruses in an e-mail sent or received by the user.

4.3 The user shall only use the CV and vacancy database and the (personal) data provided therein for the purpose for which it is intended, namely the placing of CVs or vacancies as well as the sending of emails to other users insofar as this takes place in the context of making an application or recruiting staff.

4.4 The user is not permitted to use (parts of) the website other than the purpose for which it is intended. This includes, but is not limited to:

4.a placing incorrect, incomplete or deliberately misleading (company) information;

4.b the modification, deletion or rendering of data of other users unusable;

4.c unsolicited sending of e-mails that are not related to the posting of vacancies or the making of applications to other users.

4.d selecting - possibly using auxiliary tools - data from other users for purposes other than those described in the previous paragraph.

4.e posting advertisements.

4.f making political statements.

4.g making discriminatory, offensive and / or hurtful statements.

4.h hindering other users in the use of the website or hindering the operation of the website.


Article 5 Payment

5.1 User payments to waterjobs.nl are always at the user's own risk.

5.2 Payments must be made in Euros only and must only be paid via credit card or IDEAL.

5.3 Vacancy (ies) will only be placed if the required amount has been paid to waterjobs.nl in one installment.

5.4 As confirmation a digital invoice will be sent by email to the specified contact person / email address.

5.5 Refunds will only take place after personal contact with the representative of waterjobs.nl and thereafter has been submitted for review.


Article 6 Privacy

6.1 The user is aware that waterjobs.nl contains personal data of other users and will treat the personal data provided to him confidentially.

6.2 The user must handle the (personal) data of third parties carefully, including the details of the candidates that have been given to the user for inspection by means of the CV database. 

6.3 The user may only use the data to approach relevant, potential candidates for the fulfillment of a concrete, existing and suitable vacancy. Any other or further processing is not permitted.

6.4 The user shall not store the data for longer than necessary for the purpose described above. When a candidate objects directly or indirectly to the use of his/her data by another user, the other user will immediately stop using it and destroy the data. waterjobs.nl does not guarantee that the above information is current, complete or accurate. waterjobs.nl accepts no liability in this.

6.5 waterjobs.nl will in no way be a party to any (employment- or temporary) agreement between, or with, a user and a candidate.

6.6 Except as explicitly permitted on the basis of these general terms and conditions, the user may not process or otherwise use (personal) data of third parties to which the user has access through or in connection with the agreement or which have been made public by or in connection with the media.

6.7 In particular, the user is not permitted to use (personal) data of third parties for the transmission of (unsolicited) communication and may not be collected methodically or systematically.

6.8 The user warrants that he acts in full compliance with the provisions of this article and all applicable laws and regulations in the field of protection of personal data and unsolicited communications, including in each case the General Data Protection Act Act. The user will fully indemnify waterjobs.nl against all possible claims of third parties on account of non-compliance by the user with the provisions of this article or of any laws or regulations relating to the protection of personal data and unsolicited communications.

6.9 The user shall also fully compensate waterjobs.nl for all damage, fines and costs that waterjobs.nl experiences in connection therewith.

6.10 In the event of violation of the provisions of this article, the user shall owe an immediately due and payable fine of € 2,500 (two thousand five hundred euros) per violation, without any warning or other prior declaration, whereby the use of one (personal) item constitutes a separate violation. This penalty is awarded to waterjobs.nl without prejudice to all other rights or claims of waterjobs.nl, including the right to fulfillment and the right to compensation in addition to the fine.

6.11 waterjobs.nl processes personal data according to the General Data Protection Act.


Article 7 Equal Opportunities Act

7.1.Waterjobs.nl will remove a vacancy if a demand or given motivation is in conflict with the frameworks published by waterjobs.nl, or if there are doubts about the legal validity thereof.

7.2 A user who notices a vacancy that is in violation of the Equal Opportunities Act, as referred to in this article, is requested to report this to rvanakkeren@waterjobs.nl - the action will then be taken as described in article 8.


Article 8 Exclusions

waterjobs.nl will proceed with the immediate removal of a CV or vacancy and exclusion of the responsible user if:

8.1 there is question of improper use within the meaning of Article 4, paragraph 4 or in any other way abuse of the facilities offered via the website;

8.2 waterjobs.nl has serious reservations about the integrity of user.

8.3 within three months there is repeated violation of the provisions of Article 6, paragraph 1.

8.4 visitors are logged through an IP address - if the website and / or its functionalities are repeatedly misused or the malicious sabotage of the waterjobs.nl functionality is used, this IP address will be used to inform your provider and in extreme cases initiate legal proceedings.


Article 9 Maintenance / malfunctions

9.1 Waterjobs.nl endeavors to provide the user with uninterrupted access to the website. However, waterjobs.nl can, without prior notice, temporarily put (parts of) the website out of use for the execution of maintenance or the elimination of faults. Waterjobs.nl will perform such maintenance work as much as possible during the less frequently used hours.

9.2 Waterjobs.nl is not liable for damage of any kind, as a result of inaccessibility of the website.


Article 10 Changes in the provision of service

10.1 Waterjobs.nl may make changes to the (access to) the services it offers via the website. Waterjobs.nl will make such changes known to its users in a timely manner.

10.2 Waterjobs.nl may send unsolicited newsletters about (the use of) the website or its services to users by e-mail.


Article 11 Intellectual property

11.1 The intellectual property rights relating to the website, including but not limited to, copyrights to the texts, photographs, images, software, design, trademark rights, etc., published by waterjobs.nl, are held by waterjobs.nl, unless stated otherwise. Logos of users that are made available remain the property of the user. Waterjobs.nl reserves the right to edit these logos in size (not the form) for use on the website: when providing a user logo, the user gives tacit permission for this.

11.2 The user is not permitted to edit (parts of) texts on the website, to copy and / or to make them available to third parties in any way. The website waterjobs.nl is fully protected in terms of content, design, and layout through copyright.


Article 12 Liability

12.1 Waterjobs.nl is not liable for the damage, of whatever nature, resulting from the use of the website, unless there is intention of waterjobs.nl or its employees.

12.2 At any given time, the information on the website may no longer be complete or accurate. Therefore no rights can be derived from the contents thereof. Waterjobs.nl advises the user to verify the accuracy and completeness of the information before taking action.


Article 13 General

13.1 By using the website, users agree to these terms and conditions.

13.2 Users will be given the opportunity to re-accept these general terms and conditions if changes have taken place. As these general terms and conditions can be adjusted in the interim, waterjobs.nl advises users to regularly review the general terms and conditions on its website www.waterjobs.nl

13.3 Dutch law applies to these general terms and conditions. Any disputes will be submitted to the court in Breda.
